These Terms and Conditions of Sale ("Terms of Sale") govern the purchase of all goods from Seconda Limited, trading as Seconda ("we," "us," "our"), whether purchased through our website at [Your Website Address] (the "Website") or in-store at Navenby, Lincolnshire. By placing an order or making a purchase with us, you agree to be bound by these Terms of Sale, along with our Privacy Policy, Cookie Policy, and Website Terms of Use.

2.1. Nature of Goods: We primarily sell pre-loved (second-hand), ex-display, and consigned formal wear, wedding dresses, bridesmaid gowns, suits, and other special occasion attire. While we pride ourselves on the quality and condition of our items, please understand that due to their nature, they may show signs of wear commensurate with their age and previous use. Any significant imperfections, defects, or specific conditions will be clearly described and/or photographed in the product listing (for online sales) or highlighted to you in-store.
2.2. Description: We take all reasonable care to ensure that all details, descriptions, and prices of products appearing on our Website or provided in-store are accurate. However, errors may occur. All descriptions, dimensions, and weights are approximate and provided for general guidance only. The images of the products on our Website are for illustrative purposes only. Your product may vary slightly from those images.
2.3. Availability: All orders are subject to availability. If an item you have ordered is not available, we will inform you as soon as possible and offer you an alternative or a full refund.
3. Pricing and Payment
3.1. Pricing: All prices are displayed in Pounds Sterling (£) and include VAT where applicable at the current UK rate. We reserve the right to change prices at any time without prior notice. However, once an order is confirmed, the price will not change for that order.

4.2. Order Confirmation: After you place an order online, you will receive an email from us acknowledging that we have received your order. This email is an order confirmation. A contract between us will be formed only when we dispatch the goods to you.

6. Returns, Refunds, and Your Rights
Your rights under the Consumer Rights Act 2015 remain unaffected by these Terms of Sale.
6.1. Online Orders (Distance Sales - Your Right to Cancel): * 14-Day Cooling-Off Period: You have a legal right to cancel an online order for any reason and receive a full refund within 14 days from the day you (or someone nominated by you) receive the goods. This is known as the "cooling-off period." * How to Cancel: To exercise your right to cancel, you must inform us of your decision by a clear statement (e.g., email or letter) within the 14-day period. You will be responsible for the direct cost of returning the goods. * Condition of Returned Goods: All goods must be returned in the same condition as when you received them, unworn, unwashed, and with all original tags, labels, and security tags (if applicable) still attached. 6.2. In-Store Purchases (No Automatic Right to Cancel): * Please note that for items purchased in our physical store in Navenby, Lincolnshire, you do not have an automatic legal right to a refund if you simply change your mind (as the Distance Selling Regulations do not apply). * Our In-Store Returns Policy: We may offer store credit or exchange for in-store purchases within [Number] days of purchase, provided the item is returned in its original condition, unworn, unwashed, with all tags attached, and with proof of purchase. If repair or replacement is not possible or fails, you may be entitled to a refund (which may be a partial refund). * After 6 months: You may still be entitled to a repair or replacement, but the burden of proof shifts to you to show the fault was present at the time of purchase. * Wear and Tear: Please remember that reasonable wear and tear for pre-loved or ex-display items is expected and does not constitute a fault unless it was not accurately described or impacts the item's intended purpose.
7. Consignment Sales (Selling Your Items to Us)
7.1. If you wish to sell your items through Seconda on a consignment basis, a separate Consignment Agreement will be provided to you. This agreement will detail the terms, conditions, pricing, commission rates, payment schedule, and responsibilities for both parties regarding the consignment sale of your items. By consigning items with us, you agree to the terms of that separate agreement.
8. Limitation of Liability
Nothing in these Terms of Sale limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be legally limited or excluded.
Subject to the above, our total liability to you in respect of all losses arising under or in connection with these Terms of Sale, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the goods you purchased.
We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business, or re-sale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
9. Events Outside Our Control
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms of Sale that is caused by any act or event beyond our reasonable control (e.g., strikes, lock-outs, civil commotion, riot, invasion, terrorist attack, war, fire, flood, earthquake, epidemic, pandemic, or failure of public or private telecommunications networks).
10. Governing Law and Jurisdiction
These Terms of Sale shall be governed by and construed in accordance with the laws of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction over any dispute arising from or related to these Terms of Sale.
11. Other Important Terms
Severability: Each of the paragraphs of these Terms of Sale operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
Waiver: If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
